Information for Residents Concerning Hardscaping (Landscaping) Projects


Hardscaping – Includes but is not limited to Patios / Pavers / Walkways / Decks / Outdoor Kitchens / Fire Pits /Retaining Walls, etc.

Dear Fair Haven Residents:

Please be aware that all outdoor projects involving hardscaping require an approved Zoning Permit Application, prior to beginning any work.  Do NOT believe any landscaper who tells you that a permit is not required for such work, as this could be a mistake that may ending up costing you additional time and money.

The reason a Zoning Permit Application is required for hardscaping is that these projects involve a change to your lot coverage, which is calculated based on a percentage of your total lot area, which varies by zone.  Proceeding with a hardscaping project without an approved Zoning Permit is in and of itself a violation of our zoning ordinance, even if the project would otherwise be allowable under the Borough’s zoning codes.

If your project creates a situation whereby your lot coverage exceeds what is permitted in your zone, Borough ordinances would require that the violation be eliminated/removed.  Alternatively, you would be required to go before the Zoning Board of Adjustment to apply for variance relief from any potential zoning violation, which is a process that takes time and has related costs.  Lastly and perhaps most important is that fact that the violation could even complicate your ability to sell your home in the future.

To avoid this potentially difficult situation from the start, please talk with the Borough’s Zoning Officer and file a Zoning Permit Application.  The Zoning Office stands ready to assist our residents and we will do our best to make the zoning application process as easy as possible, so you won’t face any unexpected issues in the future.
